Amsterdam, 22 September – The Foundation Human Rights for Eritreans has decided to withdraw the lawsuit filed against the European Union (EU) over 80 million euros in aid provided to Eritrea. This decision was taken in response to the ‘no more roads’ approach announced by the EU, after repeated criticism of its financial support.

“We will continue our investigation into forced labour in Eritrea and will come back to this issue if new facts come to light.” States Muluberhan Temelso, Director of the Foundation.

Legal case

The lawsuit was filed on 13 May 2020 in relation to EU funding of a project in Eritrea which uses forced labour from the Eritrean national service. This is openly acknowledged by the EU. The situation is and remains contrary to the most fundamental norms of international and European law.

In response to criticism from the media, the European Parliament, and European member states, partly as a result of this lawsuit, the EU has indicated that it will change its policy with regard to road construction projects in Eritrea. The EU has announced a ‘no more roads’ approach, whereby further funds that were earmarked for road construction on top of the 80 million euros have been diverted to Sudan and other projects in Eritrea. The EU will also evaluate the ‘dual track approach’ of diplomatic relations with Eritrea, of which the road building project was a part.

The Foundation is largely pleased with these steps, says Emiel Jurjens, the Foundation’s lawyer. “The EU has recognized that supporting a project using forced labour is unacceptable. That is why the EU has now abandoned this policy by saying “no more roads”. The goal of the Foundation has thus been achieved. This is an important victory that means alot to the Foundation and to the Eritrean people”. However, this does not change the fact that the human rights situation in Eritrea remains of great concern.

Ongoing concerns

With these new developments, which are considered as unconditional and permanent by the Foundation, the core requirements of the lawsuit have been met. However, the Foundation will continue to closely monitor the situation and continue its investigation into aid in Eritrea implemented through use of forced labour.

The Foundation remains very concerned about the way aid is organized through the EU Emergency Trust Fund for Africa (EUTF). From the beginning, the EU knew that forced labour would be used in the implementation of the road construction project, and the EU agreed with this. The EU argues that a national court could not review this case, but a collective claim cannot be reviewed by an EU court. “If this argument is followed, cases where the victims cannot be directly present, for example because they are still in repressive countries such as Eritrea, cannot be reviewed. This puts the EUTF in a legal vacuum,” states Jurjens.

“We remain seriously concerned about the road building project.” Says Temelso. “For example, the EU indicates that money will still end up in organizations under the control of the Eritrean regime, specifically the Red Sea Trading Corporation. It is not clear how the EU can adequately control this.”

Eritrea: E.U. promises no more roads “Forced Labor

The European Union has announced that it will no longer be funding road construction projects in Eritrea, resulting in the withdrawal of a months-long lawsuit against the bloc.

In May, the Amsterdam-based group Foundation Human Rights for Eritreans had filed a lawsuit against the E.U. for funding a construction project it openly acknowledged used forced labor.

The project, a road connecting the Ethiopian border with the port city of Massawa, was revealed in January to use National Service conscripts, meaning the participation of an unknown number of its workers was forced.

The E.U. partly financed the project by paying for heavy equipment through its Emergency Trust Fund For Africa—a notoriously opaque fund set up in 2015 as part of an effort to stem migration.

But the E.U. has now announced, partly in response to the lawsuit, that It will no longer be funding road projects in Eritrea, diverting all funds to other projects in the country and beyond.

Kennedy Van Der Laan, the law firm representing the Foundation, announced in a press release this week that it has withdrawn the lawsuit as a result of the move—but that concerns remain.

The fact that some funds are still going to Eritrea, including to its effectively non-existent judiciary system, means that the E.U. is still supporting the National Service indirectly.

International actors can help to bring an end to forced labor in the country by making it both politically and economically costly for the system to continue.

Freedom United has gathered over 10,000 signatures calling on foreign businesses and institutions to divest from the country and declare their opposition to forced conscription.

Habte Hagos, founder and chairman of Eritrea Focus, and Martin Plaut, the former editor of BBC World Service Africa and author of Understanding Eritrea, will discuss the persistence of forced labor in Eritrea and the importance of Freedom United’s divestment campaign.

...Many prisoners in Eritrea are held in severely overcrowded prisons where they are constantly in danger of beatings and abuse. Their shelter? Metal shipping containers that expose them to the heat in the day and cold at night. Many Christians have died under such harsh conditions, and others have fled the country to avoid them.

Musselman says only a tiny fraction of Christians have been released, but he is hopeful that more will be released in the coming days. In July, 22 Methodist prisoners were released as well.

I can see his end approaching brother lil kogne, so I'm not bothered at all.

I've had my back & forth with this guy for years & I know his tactics of changing the subject every time he gets cornered and I know he can't respond to brother Fed_up's call to defend himself on his claims of "Ethiopiawnet". I'm well aware, his interest is not to know what we think about issues but to bully & harass, & that he only got hate for everything Eritrean. He wants Eritrea to lose even in sports & I don't know of any Eritrean govt critic, who would go that far.

Having said all this, & as I've said it before to other brothers who advised me to let it go is that I do it, for the sake of some reader/s who might take his words as truth. Especially, when he invokes foreign powers with historical animosity towards Eritrea and a dislike of the country being a reality on the world map. This is much bigger than PIA, eventhough he tries to cover it up by continiously mentioning him. This is about eliminating Eritrea from the map, or at least render it ungovernable & in chaos.

The decision caused outrage in human-rights circles. But that did not stop the bloc in December from deciding to give Eritrea tens of millions more, funding a system of forced conscription that the United Nations has described as “tantamount to enslavement.”..
