On 19 Dec 2005, the Eritrea-Ethiopia Claims Commission ruled Eritrea's use of force in 1998 to retake Badme was not justified but stated that it didn't regard its jus ad bellum (Rights in war) finding that Eritrea initiated an aggressive war. In 2021, Ethiopia admitted TPLF instigated the War.

The Com. rejected, Ethiopia's contention that Eritrea carried out a program of pre-planned & coordinated armed attacks in multiple locations.The fact that Eritrea’s armed forces were more fully mobilized than those of Ethiopia, does not prove that Eritrea’s actions were predetermined.
